TERMS OF SERVICE for The Heart Portal

Welcome to The Heart Portal Membership by Julie Zhenning. This agreement outlines the terms for accessing our spiritually-guided membership programs. By enrolling, you agree to abide by these terms.

1. Membership & Access

Subscription Levels:
  • Foundation Circle: $397/month
  • Heart Circle: $1497/month
  • Consciousness Circle: $2,997/month
Billing:
  • Monthly auto-renewal on the same calendar date as enrollment
  • If your enrollment date doesn’t exist in a future month (e.g., January 31st), billing occurs on the last day of that month.
  • First payment is charged immediately upon sign-up.
  • Payments are processed via credit card only.
  • Manual payments are not accepted.
Failed Payment Protocol:
If your monthly payment fails, you will retain access for 5 additional days while we attempt to process payment. During this grace period, you may update your payment method via your member dashboard. If payment is not successful within 5 days, your access will be suspended until payment is updated.
  • Day 1: Payment fails — immediate retry + email notification
  • Day 3:e Second retry + email notification
  • Day 5: Final retry + final notice email
  • Day 6: Access is suspended
  • Access Reinstatement: Restored immediately upon successful payment

2. Community Guidelines

We hold this space as sacred, sovereign, and spiritually safe.
Expectations:
  • Engage respectfully and compassionately.
  • Maintain confidentiality of shared experiences.
  • Avoid unsolicited advice or promotional content.
  • Uphold the energetic integrity of the space.
Violations:
  • Disruptive or inappropriate conduct may result in suspension or permanent removal without refund.

3. Content & Intellectual Property

All content, including live sessions, meditations, workbooks, and proprietary materials, is the intellectual property of Julie Zhenning.
Usage:
  • Licensed for personal use only.
  • Sharing, copying, or recording is strictly prohibited.
  • Downloading materials is not allowed unless explicitly stated.
Live Calls:
  • Licensed for personal use only.
  • Sharing, copying, or recording is strictly prohibited.

4. Cancellation & Refund Policy

Cancellation:
  • Cancel anytime through your member dashboard.
  • Access continues until your next billing date.
  • No partial or prorated refunds
Post-Cancellation:
  • Access to content and community expires on your billing date.
  • Downloading or retaining materials after cancellation is prohibited.
Refunds:
  • All sales are final. No refunds are offered under any circumstance, including inactivity.

5. Disputes & Chargebacks

Please contact us first at info@juliezhenning.com before initiating a chargeback.
Chargebacks:
  • May result in immediate account termination and permanent ban from future programs
  • We reserve the right to pursue recovery of funds for unauthorized chargebacks, including legal and administrative fees.

6. Limitations & Disclaimers

  • This program is for educational and spiritual purposes only and does not substitute for medical advice.
  • No fertility outcomes are guaranteed.
  • You are responsible for your own health choices and decisions.
Limitation of Liability:
To the fullest extent permitted by law, we disclaim any liability for indirect, incidental, or consequential damages. Our total liability shall never exceed the membership fees paid during the previous 3 months.

7. Platform Usage & Technical Terms

Technology Platforms:
  • Course materials are hosted on MemberPress
Platform Outages:
  • We are not liable for downtime or interruptions caused by third-party platforms.
  • Scheduled maintenance may occur without prior notice.
Member Responsibilities:
  • Keep your login credentials secure.
  • We are not liable for unauthorized access due to negligence.

8. Governing Law & Jurisdiction

This agreement is governed by the laws of the State of California, with venue in San Diego County.

9. Dispute Resolution

If a dispute arises:
  1. Informal Resolution: Members agree to attempt good faith resolution via email.
  2. Mediation: If unresolved, parties agree to mediate in San Diego County, California.
  3. Arbitration: Failing mediation, the dispute will be submitted to binding arbitration under AAA rules.
  4. Court Injunctions: Either party may seek injunctive relief in a competent court if necessary.

10. Force Majeure

We are not liable for delays or interruptions caused by events beyond our control, including natural disasters, pandemics, service outages, or government mandates.

11. Privacy Policy

By joining, you agree to our Privacy Policy. Your personal data is used in accordance with our commitment to confidentiality and respect.

12. Terms Revisions

We may update these Terms at any time. You’ll be notified of significant changes. Continued use of the membership confirms your acceptance of the revised terms.
